What Mount Carmel's governing documents say
Mount Carmel is a single-family home subdivision within the larger Village at Motts Landing planned community in Wilmington, NC. This declaration establishes the homeowners' association (The Village at Motts Landing Homeowners' Association) and sets rules for lot owners, covering assessments, architectural control, and use restrictions.
- What you own & maintain: You own your lot and the single-family dwelling on it. The association maintains common elements (private streets, recreational spaces, detention ponds, etc.) and may provide mandatory lawn maintenance for a monthly fee. Each owner must keep their lot free of weeds and debris, and maintain sodding in front, side, and rear yards.
- Assessments & fees: Owners pay annual assessments for common expenses, plus possible special assessments, insurance assessments, ad valorem tax assessments, and a one-time $250 working capital assessment upon purchase. Assessments are uniform for similarly situated lots; the board sets the budget and may require monthly installments. Unpaid assessments accrue interest and become a lien on the lot.
- Architectural review: All exterior construction, alterations, painting, fences, and landscaping must be approved in writing by the Declarant or later the Architectural Control Committee. Plans must be submitted; approval or denial must occur within 30 days. Minimum dwelling size is 2,000 heated square feet (may be reduced up to 10% for hardship). Exterior must be completed within 12 months of construction start, or fines up to $1,000/month may apply.
- Land use & building type: Lots are for single-family dwellings only, no more than 2.5 stories. No trailers, mobile homes, modular homes, or temporary residences are allowed. No lot may be subdivided without consent.
- Pets: Household pets (dogs, cats, etc.) are allowed, but no more than three per household. They must be leashed, not a nuisance, and not kept for commercial purposes. The association may adopt rules on waste removal, noise, and occupancy limits.
- Parking & vehicles: Off-street parking for at least two cars must be provided on each lot. No boats, campers, trailers, inoperable vehicles, or vehicles without current registration/insurance may remain on lots or streets. Repairs must be in garages or not visible from the street. Motorized off-road vehicles (dirt bikes, ATVs) are prohibited on common elements.
- Leasing & rentals: The document does not address leasing restrictions or minimum lease terms.
- What this document doesn't cover: This declaration does not specify current assessment amounts, age restrictions, or detailed rules on satellite dishes (except size/placement), statuary, or exterior lights. It also does not cover rental caps or pet deposits.
