Sycamore Grove is a planned single-family home community in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that applies to all lot owners, residents, and guests. It covers property rights, HOA assessments, use restrictions, architectural control, and maintenance obligations.
- What you own & maintain: You own your lot and the dwelling on it. You must maintain your lot (lawn, trees, drainage easements) and the exterior of your home (walls, roof, paint). The HOA maintains common areas, sidewalks, stormwater ponds, and certain drainage easements.
- Architectural review: Any new construction, exterior changes, fences, or painting must be approved in writing by the Declarant (developer) or later by the HOA board or architectural committee. Plans are reviewed for harmony of design and location. Approval is deemed given if no response within 30 days.
- Minimum dwelling size & construction timeline: Each home must have at least 2,400 square feet of enclosed, heated living area (excluding garages, decks, porches). Exterior construction must be completed within 12 months of starting, unless hardship extensions are granted.
- Parking & vehicles: Each lot must provide off-street parking for at least 2 cars. On-street overnight parking is prohibited. Boats, campers, trailers, RVs, and inoperable vehicles cannot be visible from the street. Vehicle repairs are only allowed in garages or areas not visible from the street.
- Pets & animals: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed and not become a nuisance. Livestock and poultry are prohibited.
- Leasing & rentals: The document does not restrict leasing terms or require HOA approval for rentals. However, all tenants must comply with the Declaration and HOA rules.
- HOA assessments & fees: Annual assessments are set by the HOA board based on an approved budget. Special assessments for capital improvements require a 2/3 vote of owners. A one-time working capital fee of $150 is due at purchase. Assessments are a lien on the lot if unpaid.
- Signs & antennas: Only one 'for sale' sign (max 2x3 feet) is allowed. Satellite dishes under 18 inches not visible from the street are permitted. Other signs and antennas require HOA approval.
