Yorke Meadow is a single-family home subdivision within the larger Village at Motts Landing planned community in Wilmington, NC. This document is the Declaration of Covenants, Conditions & Restrictions (CC&Rs) that applies to all lot owners in Yorke Meadow. It establishes a homeowners' association (the Village at Motts Landing HOA) and sets rules for property use, assessments, and architectural control.
- What you own & maintain: You own your lot and the house on it. You must maintain your lot free of weeds and debris, keep landscaping healthy, and complete exterior construction within 12 months. The HOA maintains common elements like private streets, recreational areas, and drainage ponds.
- Assessments & fees: All lot owners pay annual assessments set by the HOA board, plus possible special assessments for capital improvements, insurance, and ad valorem taxes. A working capital assessment equal to two months' assessments is due when you buy from the developer. Unpaid assessments become a lien on your property.
- Architectural review: Any exterior changes (including painting, fences, additions) require written approval from the Architectural Control Committee. Houses must be at least 2,000 square feet of heated living area (garages and decks excluded). Fences cannot exceed 6 feet in height or be placed forward of 15 feet behind the front of the house.
- Land use & building type: Lots are for single-family residential use only. No duplexes, apartments, mobile homes, or temporary structures as residences. Only one dwelling per lot, max 2.5 stories.
- Pets: Up to three household pets (dogs, cats, etc.) are allowed, but they cannot be kept for commercial purposes, must be leashed when outside, and must not become a nuisance. The HOA may adopt additional pet rules.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars. Boats, campers, trailers, and inoperable vehicles cannot be parked on lots or streets without HOA consent. No vehicle repairs visible from the street. Motorized off-road vehicles (dirt bikes, ATVs) are not allowed on common areas or undeveloped lots.
- Leasing & rentals: The document does not address leasing restrictions. Rentals are not prohibited or limited by this declaration.
