What Equestrian Estates's governing documents say
Equestrian Estates is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1978. These rules apply to all homeowners on the listed lots and cover land use, building standards, and property maintenance.
- Land use & housing type: All lots must be used for single-family residential purposes only. No dwelling may exceed two and a half stories. After the main residence is built, you may add a garage, guest house, greenhouse, hobby workshop, barn, or stable if permitted by county zoning.
- Minimum house size: Each dwelling must have at least 1,200 square feet of interior living space, excluding open porches, garages, carports, and outbuildings. The developer may approve a variance of up to 10% less.
- Setbacks & lot lines: Buildings must be at least 25 feet from the front road right-of-way and at least 15 feet from side and rear property lines.
- Architectural & materials review: Plans and building location must be approved by Equestrian Estates, Ltd. before construction. Dwellings must be wood, stone, brick, brick-veneer, tile and stucco, concrete and stucco, or an approved combination. No mobile homes or moved buildings are allowed. Attached garages must match the dwelling's materials.
- Horses & livestock: You may keep horses and ponies on your lot, subject to county zoning, but no other livestock or poultry is allowed.
- Easements & drainage: The developer reserves utility easements (rear 20 feet, front 10 feet, 10 feet along sides). No structures, plantings, or materials may interfere with utilities or drainage. You must install and maintain culverts (minimum 12-inch diameter) under driveways crossing ditches, and you are responsible for maintaining drainage on your lot.
- Sewer & water: Until municipal sewer is available, you must use a septic tank approved by the county or state health board, and water must come from individual wells.
- What this document doesn't cover: This document does not create a homeowners' association, set dues or fees, regulate leasing, or address amenities like a pool or clubhouse. It also does not cover parking, noise, or pets beyond horses.
