Lake Brewster is a standard single-family home HOA in Wilmington, NC. The rules apply to all lot owners and residents. This is a full rulebook covering use restrictions, assessments, architectural control, and maintenance obligations.
- Residential use & home businesses: All lots are for single-family residential use only. No home business or occupation is permitted. Only one detached single-family dwelling per lot, max 2 stories, minimum 1,200 sq ft enclosed area.
- Architectural review: Any exterior structure or change (fences, mailboxes, patios, sheds, pools, etc.) must be approved in writing by the Architectural Review Committee (ARC) before construction. Plans are reviewed within 30 days; disapproval must state reasons. ARC decisions are final.
- Assessments & fees: Annual assessments are set by the Board, initially capped at $240 per lot per year, with annual increases up to 10% unless 2/3 of members approve more. Special assessments require 67% member vote. Late fees up to $20/month or 10% of unpaid amount, plus 12% interest. Working capital fee of 2 months' assessment due at initial sale.
- Parking & vehicles: No street parking except for short-term visitors or deliveries. All vehicles must be parked in the driveway. No parking on grass. No inoperable or dismantled vehicles. Boats and trailers require written approval and must be stored in the driveway with a covered boat; empty boat trailers prohibited.
- Pets & animals: Dogs, cats, and other household pets are allowed but not for commercial breeding. No livestock or poultry. Pets must be leashed and owners must clean up waste.
- Trash & mailboxes: Trash containers must be kept behind the front of the home except within 24 hours of pickup. Mailboxes must be of a design approved by the ARC.
- Yard sales & signs: Yard sales allowed only on Fridays, Saturdays, and Sundays; signs must be removed within 48 hours. No other signs except a temporary 'For Sale' sign or small owner identification sign (max 2 sq ft total).
- Fines & enforcement: Violations result in a written notice, then escalating fines: $25 (second), $50 (third), $100 (fourth). Owners may request a hearing within 15 days of notice. The Association may also enter the lot to perform maintenance and charge the owner.
