Overlook at River Place is a condominium community in Wilmington, NC — you own your individual unit and share ownership of the building's common elements, which the association maintains and insures, funded by per-unit assessments. This declaration governs all unit owners, residents, and guests.
- What you own & maintain: You own the interior of your unit, including finished surfaces, fixtures, and appliances within its boundaries. The association maintains the common elements (e.g., building structure, exterior windows and doors, balconies) and limited common elements (e.g., HVAC systems outside your unit), with costs for limited common elements billed to the benefiting owner.
- Leasing & rentals: Leases must be for six months or longer; short-term/vacation rentals (e.g., Airbnb, VRBO) are prohibited. No more than 20% of units may be owned by a single owner (other than the developer). Owners must notify the association in writing when leasing.
- Pets: A maximum of two domestic pets per unit is allowed. Non-domestic pets are prohibited. Pets cannot be kept for commercial purposes or breeding. Any pet causing a nuisance or unreasonable disturbance must be removed within 10 days of written notice. Pets must be leashed outside units, and owners must clean up pet waste.
- Parking & vehicles: There is no on-site parking within the condominium. Parking is provided via a sublicense agreement with the City of Wilmington's River Place parking garage. Each unit owner must enter into a parking sublicense; two-bedroom units may sublicense an additional space. The initial fee is $100/month per space, payable as part of common expenses. The association may enforce parking rules via fines, towing, or booting.
- Use restrictions: Units are for residential, noncommercial use only. Working from home is allowed if the unit remains primarily residential. No day care, group homes, or time-share programs are permitted. No unusual odors or noise may emanate from units. Smoking is prohibited in interior common elements. Garbage and recycling must be placed in designated receptacles.
- Signs, flags & political signs: Signs, banners, and flags are generally prohibited except: 'For Sale' or 'For Lease' signs up to 2 sq ft (max 60 days per year); U.S. and North Carolina flags up to 4x6 ft; and political signs up to 2x2 ft, displayed no more than 45 days before an election and removed within 7 days after. Only one political sign per unit.
- Alterations & improvements: Owners may make interior improvements that do not affect common elements or structural integrity. Removing partitions between adjoining units is allowed but requires association notice, permits, insurance, indemnification, and reimbursement of association expenses. Subdivision of units is prohibited.
- Assessments & fees: The association levies periodic assessments for common expenses, payable monthly. Special assessments may be imposed for capital improvements or extraordinary expenses. Late payments incur a charge of the greater of $20 or 10% of the unpaid amount. The association may file a lien for unpaid assessments.
