Middleborough is a single-family residential subdivision in Wilmington, NC. These covenants, conditions, and restrictions (CC&Rs) run with the land and bind all lot owners, focusing on residential use, minimum house size, architectural standards, and property maintenance.
- Residential use only: All lots are for single-family residential purposes only. No house trailers, mobile homes, travel trailers, tents, or temporary structures may be used as a residence without developer consent.
- Minimum house size & construction standards: Each residence must have at least 1,700 square feet of heated floor space (excluding porches, garages, etc.) and a garage for at least one car. Exterior materials are limited to conventional frame, wood, vinyl, masonite-type hardboard, brick, clay brick, or stucco; exposed foundations must be brick, stone, or stucco. Roofs must have a minimum pitch of 6/12 and earth-tone shingles.
- Architectural & site review: All building and landscaping plans must be submitted to the developer for approval before construction. No lot may be clear-cut, and no tree over 10 inches in diameter (at ground level) may be cut without written consent (violation penalty: $300 per tree). Setbacks: at least 40 feet from front lot line, 10 feet from side lines, unless developer approves a different setback.
- Fences, hedges & gardens: No fence or hedge may be erected without developer approval. Fences facing or parallel to the street must be wood. No fence or hedge is allowed nearer the front lot line than the front of the house. Gardens must be at least 15 feet behind the back corner of the house.
- Parking & vehicles: Each lot must have a paved driveway and off-street parking for at least two cars. No inoperable vehicles, vehicles without current registration/insurance, large vehicles (over 3/4 ton), buses, or tractor-trailers are permitted. Boats must be stored in a building or in the back yard not visible from the street.
- Pets & nuisances: Household pets are allowed subject to city/county ordinances and leash laws. No domesticated farm animals or fowls. No noxious or offensive activities, and no plants, animals, or devices that are dangerous, unsightly, or unpleasant.
- Prohibited activities & items: No yard sales or garage sales. No clotheslines visible from the street (portable clothes tree stands allowed if not visible). No outside radio or TV antennas without developer permission. No fuel tanks exposed to view. No advertising signs except one 'For Sale' sign of up to 5 square feet on improved lots.
- Maintenance obligations: Lot owners must keep their lot mowed (including area to the edge of the paved street) and free of unsightly objects. The developer may enter and clean up at the owner's expense if the owner fails to do so. Owners must also maintain drainage easements on their lot.
