What Georgia Place's governing documents say
Georgia Place is a single-family home subdivision in Wilmington, NC. These restrictive covenants run with the land and bind all current and future lot owners. The rules cover what you can build, how you can use your property, and how you must maintain it.
- Residential use only: Lots may only be used for residential purposes. No commercial trade or activity is allowed on any lot.
- Building & design standards: Only one detached single-family dwelling (max 2.5 stories) and a private garage (max 1 story) are allowed. Minimum living area is 1,000 square feet (excluding porches, garages, carports). All building designs must be approved by the Developer (or their agent) and must be in harmony with existing structures. Exterior materials must be wood, brick veneer, stucco, vinyl siding, or approved synthetic materials; detached structures must match the main dwelling's materials and appearance.
- Setbacks & lot lines: Buildings must be at least 25 feet from the front lot line, 10 feet from any side street line, and 5 feet from any side lot line. Overhangs up to 3 feet and stoops/steps are allowed within setbacks. Lots cannot be subdivided or boundary lines changed without Developer consent.
- Maintenance & nuisance: Owners must keep their property neat and tidy, with no unsightly debris or litter. No noxious or offensive activities. Junk cars, inoperative machines, and similar eyesores are prohibited. Mechanical work on vehicles is only allowed in back yards. Boats, RVs, semi-trucks, and similar vehicles may only be parked in the back yard. No more than 3 motor vehicles per home, all in good running order with current inspection and plates.
- Pets: Only household pets are allowed, and they cannot be kept, bred, or maintained for commercial purposes. Pets must be kept inside, in an approved fenced area, or on a leash.
- Fences & signs: Fences cannot exceed 6 feet in height and must be approved by the Developer. Signs are limited to 'For Sale' or 'For Rent' signs no larger than 5 square feet. Satellite dishes must be placed behind the main dwelling and out of view from the street. Clotheslines must be screened from public view.
- Other restrictions: No temporary structures (trailers, tents, etc.) used as residences. All buildings must be maintained in good repair; debris must be cleared within 90 days after fire or casualty. Window treatments must be permanent (no sheets or towels) and installed within 30 days of occupancy. Mailboxes and newspaper boxes must be approved by the Developer and match the first installed design.
- Enforcement & amendments: Any lot owner can sue to enforce these covenants and recover costs and attorney's fees. The restrictions can be amended by written document signed by the Developer and affected lot owners, but until 90% of lots are sold, only the Developer can consent to changes. These restrictions remain in effect until December 31, 2026.
