Greenbriar Subdivision is a single-family home community in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and residents, limiting lots to one detached single-family dwelling and prohibiting commercial use, temporary structures, and noxious activities.
- Permitted use: All lots are for single-family residential use only. No commercial use, home business, or occupation is allowed.
- Dwelling requirements: Only one detached single-family dwelling (max 2.5 stories) and a private garage for up to two cars may be built. Minimum interior living space is 1,300 square feet (excluding porches, garages, etc.).
- Setbacks & building lines: Buildings must be at least 30 feet from the front street line and no closer than 10% of the lot's frontage width to any side property line.
- Temporary structures & trailers: No house trailer, mobile home, tent, shack, basement, garage apartment, barn, or other outbuilding may be used as a residence, temporarily or permanently. No temporary structure or trailer may be placed on a lot.
- Nuisance & maintenance: No noxious, offensive, or annoying activity is permitted. Each owner must keep their lot and buildings clean, sightly, and well-maintained to avoid decreasing neighborhood beauty.
- Architectural review: Design, plans, and specifications for any dwelling must be approved by the Declarants (or their agents) before construction. Approval is given or denied within 10 days of request; if no response, approval is not required as long as the design harmonizes with existing structures.
- Construction materials: Dwellings must be built of wood, brick, brick veneer, stone, concrete, concrete blocks, tile and stucco, or concrete and stucco. Garages must match the dwelling's material.
- Sewage disposal: Until municipal sewage is available, sewage must be disposed of via a septic tank approved by the North Carolina State Board of Health.
