What Hidden Valley's governing documents say
Hidden Valley is a single-family home subdivision in Wilmington, NC. These covenants run with the land and bind all current and future lot owners. The rules are enforced by lot owners, not by a homeowners association.
- Land use & building type: All lots are for single-family residential use only. Dwellings cannot exceed 2.5 stories. No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences.
- Minimum house size: Every dwelling must have at least 1,300 square feet of living area (exterior foundation measurement, excluding porches, steps, garages, carports, and storage areas).
- Construction materials & design: Dwellings must be wood, stone, brick, brick-veneer, tile and stucco, concrete and stucco, or asphalt shingles. Garages and carports must match the dwelling's materials. All designs must be appropriate to the area.
- Setbacks & lot lines: Buildings must be at least 50 feet from the front property line and 10 feet from side boundaries. On corner lots, the side with less street frontage is considered the front. Owners of two or more lots may combine them for one residence, ignoring interior boundary lines.
- Architectural review: Plans and location for any building must be approved by the developer (Hidden Valley Corp. of Wilmington). If the developer fails to approve or disapprove within 10 days of submission, approval is not required, provided all other restrictions are met and the plans harmonize with existing buildings.
- Fences & signs: Fences must be wood or chain link and cannot be placed nearer the front street line than the rear corners of the house. Signs are limited to private name plates, identification signs, and 'For Rent' or 'For Sale' signs.
- Nuisances & animals: No noxious or offensive trades or activities are allowed. No domesticated farm animals or fowls may be kept. Inoperative junk cars and similar eyesores are prohibited; unmaintained yards may be cleaned at the owner's expense and the cost becomes a lien.
- Utilities & drainage: Water must come from the community water system; no wells without the water company's consent. Owners must install and maintain a driveway culvert (minimum 12-inch diameter) to prevent drainage blockage. The developer has easements for utilities and may cut trees or grade for maintenance.
