Horndale is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all current and future lot owners and are intended to maintain a uniform residential character.
- Permitted uses: All lots are for residential use only, except Lots 1, 2, 15, and 16, which may also be used for commercial purposes. No lot may be used as a public or private street or roadway, except for incidental driveways.
- Building & design restrictions: Only one detached single-family dwelling (max two stories) and a private garage for up to two cars are allowed per lot. Plans must be approved in writing by the developers (Hardy T. Taylor and Hosea L. Horne, or their nominee) to ensure uniform design, size, type, cost, and appearance. No dwelling may have less than 1,000 square feet of floor space.
- Setbacks: No building may be located nearer than 60 feet to the front lot line or nearer than 10 feet to any side lot line.
- Nuisance & commercial activity: No noxious or offensive trade or activity is allowed. No commercial activity is permitted on any lot except Lots 1, 2, 15, and 16.
- Temporary structures & residences: No temporary structure, trailer, tent, shack, garage, barn, or other outbuilding may be used as a residence, either temporarily or permanently. Living quarters for servants above a garage are allowed once the main building is completed.
- Animals: Hogs, cattle, sheep, goats, and other livestock are prohibited. Dogs, cats, other household pets, horses, and poultry may be kept, but not for commercial purposes.
- Waste & sanitation: No lot may be used as a dumping ground. Rubbish, trash, garbage, and other waste must be kept in sanitary containers. Incinerators must be kept clean. Surface closets or out-houses are prohibited. Sewage disposal must be by septic tank complying with state health board requirements until a general sewage system is installed.
- Lot changes & drainage: No changes to lot layout shown on the recorded map are allowed without written consent of the developers (or their nominee). No culvert or pipe may be placed in any street or road ditch or drain without their express consent.
