Carmel at Vineyard Green is a single-family home subdivision in Wilmington, NC. These covenants run with the land and bind all lot owners, their heirs, and successors. The document sets rules for residential use, construction, maintenance, and a homeowners' association.
- Residential use & structures: Lots are for single-family residential use only. No temporary structures, trailers, or mobile homes are allowed as dwellings. Only one residential building per lot, with a garage permitted in the rear yard. Dwellings and accessory buildings cannot exceed two stories without written approval.
- Minimum dwelling size & parking: Each dwelling must have at least 1,650 square feet of heated living area (1,600 with approval). Porches, carports, and garages are excluded. At least two off-street parking spaces must be provided per dwelling, connected by a driveway of approved material.
- Impervious surface limit: No more than 3,498 square feet of any lot may be covered by structures or paved surfaces (including walkways, driveways, patios). The developer may recalculate this limit to comply with North Carolina stormwater regulations.
- Architectural review: All construction and exterior alterations require prior approval from the Developer or Architectural Control Committee. Approval may be based on aesthetic or environmental grounds. Plans are deemed approved if not acted upon within 30 days. Exterior materials must be wood, brick, stone, stucco, or approved siding; concrete block must be covered.
- Construction timeline: Construction must be completed within 12 months of commencement, unless delayed by strikes, fires, national emergencies, material shortages, or acts of God. Extensions may be granted in writing.
- Lot maintenance & nuisances: Owners must keep lots clean, mowed, and free of debris. No noxious, offensive, or hazardous activities. No fowl, livestock, or farm animals; only customary household pets allowed, not in nuisance numbers. No salvaged materials, boats, campers, inoperable vehicles, or vehicle repairs visible from the street.
- Fences, signs, & antennas: Fences require approval and cannot be located forward of a point three feet behind the front of the dwelling. No clotheslines visible from the street. One 'For Sale' sign up to 5 square feet is allowed. Satellite dishes up to 24 inches in diameter are permitted in the rear yard if not visible from the street. No other outdoor antennas without permission.
- Homeowners' association & assessments: The Carmel at Vineyard Green Home Owners' Association is responsible for maintaining stormwater controls, cul-de-sac islands, and signage. Each lot owner is automatically a member and must pay assessments, including a one-time working capital charge of $350 upon purchase from the developer or builder.
