Woods Edge is a single-family home HOA in Wilmington, NC. You own your lot and house; the association maintains common areas and enforces rules to protect property values. This declaration governs all lots in the development and binds all owners, tenants, and occupants.
- What you own & maintain: You own your lot and dwelling. The association maintains common areas (e.g., streets, open spaces) and may insure them. You must keep your lot free of weeds, debris, and unsightly conditions; the association can enter and clean at your expense after 30 days' notice.
- Architectural review: Any new construction, exterior alteration, or painting requires prior written approval from the Declarant (or later the Board/Architectural Control Committee). Approval may be based on any ground, including aesthetics. If no decision within 30 days, approval is deemed given.
- Minimum house size: New houses must have at least 1,350 square feet of enclosed, heated dwelling area (excluding garages, decks, porches). The committee may allow 1,300 square feet if it won't hurt property values.
- Setbacks & lot coverage: No dwelling closer than 7.5 feet to an adjoining property line. No more than 3,000 square feet of any lot may be covered by structures or paved surfaces. Two-thirds of the lot must drain to the street.
- Use restrictions: Lots are for single-family residential use only. No temporary structures, trailers, or tents as residences. No boats, campers, mobile homes, inoperable vehicles, or tractor-trailers may remain on lots or streets without permission. Vehicle repairs only in garages, not visible from street.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed or controlled and not become a nuisance. No livestock or poultry.
- Signs, antennas & satellite dishes: Signs require Board permission. Satellite dishes up to 24 inches are allowed in the rear yard if not visible from the street. Other antennas need Board approval. No yard statuary without permission.
- Assessments & fees: Annual assessments are set by the Board and can increase up to 10% per year without a vote; above 10% requires 2/3 member vote. Initial cap of $300 per lot. Special assessments for capital improvements need 2/3 vote. A one-time working capital fee of $150 is due at purchase from Declarant. Assessments are uniform per lot and may be collected monthly.
