Waterford Place is a single-family home subdivision in Wilmington, NC. These covenants run with the land and bind all lot owners. The rules focus on residential use, building standards, and property maintenance.
- Allowed uses: All lots are for residential purposes only. No commercial use, noxious activity, or nuisance is permitted.
- Building & design standards: Only detached single-family dwellings up to 2.5 stories are allowed. Minimum dwelling size is 1,100 square feet (excluding porches, garages, etc.). Maximum lot coverage by structures and paved surfaces is 2,700 square feet. Setbacks: at least 25 feet from front property line, 5 feet from side boundaries, and 10 feet from existing buildings on adjoining lots.
- Architectural review: All building designs must be approved by the Declarant (or designee). Plans must include a plot plan. The Declarant has 20 days to approve or disapprove; if no response within 20 days, approval is not required as long as the design is in harmony with existing structures.
- Construction timeline: Exterior of all houses and other structures must be completed within 12 months after construction commences, unless delayed by strikes, fires, national emergency, or natural calamities.
- Vehicles & parking: No buses, trucks over one ton, unsightly or inoperative cars, or vehicles without current registration and insurance are permitted on any lot or street. Boats, trailers, campers, and similar items must be parked in a garage or screened area behind the dwelling, not on streets.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, or other household pets are allowed but not for commercial purposes and not in numbers or of a nature that becomes a nuisance.
- Fences & satellite dishes: No television satellite signal receiving dishes are permitted. No chain link or wire fences may be placed nearer the street than the rear line of the main dwelling.
- Maintenance & nuisances: Each lot owner must maintain their property in a reasonable state of repair. If yards are not properly maintained, the Declarant may clean up at the owner's expense. Debris from fire or other casualty must be cleared within 90 days.
