Wood Duck Forest is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Covenants that runs with the land. All lots must be used exclusively for single-family residential purposes, and owners are automatically members of the Wood Duck Forest Owners' Association, which maintains stormwater controls and can levy assessments.
- Residential use & structures: Each lot is limited to one single-family dwelling, no trailers or temporary structures. Dwellings must have at least 1,100 square feet of heated living area (excluding porches, carports, garages) and cannot exceed two stories. Accessory buildings (e.g., garages) are allowed only in the rear yard and must be compatible with the dwelling.
- Impervious cover limit: No more than 3,433 square feet of any lot (including street right-of-way) may be covered by structures or paved surfaces (walkways, driveways, patios) to comply with North Carolina stormwater regulations.
- Homeowners' association & assessments: The Wood Duck Forest Owners' Association owns and maintains the subdivision's stormwater controls. By accepting a deed, each lot owner becomes a member, must pay assessments for facility maintenance, and is subject to the association's bylaws and rules.
- Parking & vehicles: Each dwelling must have at least two off-street parking spaces connected to a street by a driveway. No 18-wheelers or school buses may be parked on site. Junked or abandoned vehicles, and campers or motor homes used as permanent residences, are prohibited.
- Pets & animals: No fowl, livestock, or farm animals are allowed. Customary household pets are permitted but must not become a nuisance or be kept for commercial purposes. Pets must be contained on the owner's lot, and the area must be kept clean.
- Architectural & construction approval: Prior approval from the Developer is required for any dwelling or accessory structure, covering site plan, parking, design, square footage, foundation, and exterior materials. Set-back requirements (30 ft from street, 8 ft from side, 15 ft from rear) may be varied by the Developer upon application. Exterior walls must use approved materials (wood, brick, stone, stucco, siding, etc.); concrete or block must be covered.
- Lot maintenance & nuisances: Owners must keep lots clean and free of debris, and maintain grass and shrubbery. No noxious, offensive, or hazardous activities are permitted. No more than two cords of firewood visible from the street. No tents, camper trailers, or motor homes used as permanent residences.
- Duration & amendment: The covenants run for 20 years from June 1993 and automatically renew for successive 5-year periods unless a majority of lot owners agree in writing to amend or rescind them.
