What Waterford Subdivision's governing documents say
Waterford Subdivision is a single-family home community in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all lot owners and residents, promoting a uniform residential character.
- Residential use only: Lots may only be used for residential purposes. No commercial, professional, or noxious activities are allowed, including doctor's offices, fraternity houses, rooming houses, antique shops, or gift shops.
- Single-family dwellings: Only one detached single-family dwelling (max two stories) plus a private garage (max one story, two cars) and incidental outbuildings (including servant's quarters) are permitted. No trailers, mobile homes, motor homes, tents, shacks, or temporary structures may be used as residences.
- Setback requirements: Dwellings must be at least 25 feet from the front lot line, 5 feet from side lines, and 20 feet from the rear line. Eave overhangs up to 3 feet and uncovered stoops/steps within setbacks are allowed. The developer may modify setbacks up to 10% with owner consent.
- Minimum floor area: The main dwelling must have at least 900 square feet of heated floor area, excluding garages, carports, porches, and outbuildings.
- Architectural review: Plans for all dwellings and structures must be approved by Masonboro Properties, Inc. (or successor). If no response is received within 20 days of submission, plans are deemed approved as long as they are in general conformity with other structures in the subdivision.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock may be raised or kept. Dogs, cats, or other household pets are allowed, but not for commercial purposes and not in numbers or of a nature that becomes a nuisance.
- Vehicles & parking: No inoperative junk cars or unsightly eyesores may be kept on any lot or street. The developer may remove such vehicles at the owner's expense.
- Fences & signs: Fences or obstructions must not extend nearer the street than the rear line of the main dwelling and cannot exceed 48 inches in height. Only one sign (max 5 sq ft) advertising the property for sale or rent is allowed, plus builder signs during construction.
