What Treybrooke Subdivision's governing documents say
Treybrooke is a standard single-family home subdivision in Wilmington, NC. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) binds all lot owners, their tenants, and guests. It establishes a homeowners association (Treybrooke HOA, Inc.) that maintains common areas and enforces rules to protect property values.
- What you own & maintain: You own your lot and single-family home. The association maintains common areas, entrance signage, planting easements, stormwater drainage, and street islands. You must maintain your own lot and keep it free of weeds, debris, and unsightly conditions.
- Architectural review: All exterior construction, alterations, painting, fences, and structures require prior written approval from the Declarant or Architectural Control Committee. Minimum house size is 2,000 sq ft of heated area; houses must have a garage. Setbacks: at least 10 ft from side property lines and 35 ft from front property line (30 ft for certain lots). Exterior must be completed within 12 months of starting construction.
- Assessments & fees: Annual assessments are set by the Board and may increase up to 5% per year without a vote; the Board can set the annual assessment up to $300 per lot without membership vote. Special assessments for capital improvements require a 2/3 vote. Assessments are a lien on the lot and a personal obligation of the owner. Unpaid assessments accrue interest and may be foreclosed.
- Use restrictions: Lots are for single-family residential use only. No businesses, noxious activities, or nuisances. Temporary structures, trailers, and recreational vehicles (boats, campers, motor homes) are not allowed without written consent. No inoperable or unregistered vehicles; vehicle repairs only in garages. Signs require permission. No satellite dishes or outside antennas without approval. Window coverings visible from outside must be white or neutral. Exterior lights must be clear, white, or non-frost.
- Pets & animals: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed and not allowed to run free. No livestock or poultry.
- Leasing & rentals: The document does not restrict leasing or set minimum lease terms. Tenants and occupants must comply with all covenants.
- Parking & vehicles: Off-street parking for at least two cars must be provided on each lot. No inoperable or unregistered vehicles, and no tractor-trailers. Vehicle repairs only in garages, not visible from the street.
- What this document doesn't cover: This document does not specify current assessment amounts, pet limits, or age restrictions. It does not address amenities like a pool or clubhouse. It is a partial excerpt (Section 1A only) and may be supplemented by later sections or amendments.
