Castle Estates is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1972. These covenants run with the land and apply to all lot owners, setting rules for residential use, building size and placement, and property maintenance.
- Residential use only: All lots are restricted to single-family residential use. No business may be conducted from a residence if there is outward evidence such as signs, commercial vehicles, or materials stored outside.
- Building size & placement: Each lot may have one detached single-family dwelling (max 2.5 stories), a garage for up to 3 cars, and incidental outbuildings. Minimum interior floor area is 1,400 sq ft (excluding porches, garage, etc.). Front setbacks are 30 ft (25 ft for Lots 2, 10, and 26), side setbacks 10 ft (one-story) or 15 ft (two-story), rear setback 25 ft. Unattached garages/outbuildings must be at least 75 ft from the front line and 5 ft from side/rear lines.
- Construction timeline: Once a structure is begun, it must not remain unfinished for more than six months from the date the foundation is laid. Exterior completion satisfies this requirement.
- Prohibited structures & nuisances: No trailers, mobile homes, shacks, tents, or barns are allowed. No noxious or offensive trade, nuisance activity, or domesticated farm animals/fowls are permitted. Inoperative junk cars and unsightly eyesores cannot be maintained on the property.
- Fences: No fence may be placed on any lot beyond the rear of the residence.
- Lot subdivision: Lots may not be resubdivided unless each part becomes part of another whole lot, and the remaining portion must contain at least 20,000 sq ft.
- Architectural review: Building designs must be approved by the developers or their appointee. Upon written request, the developer has 10 days to approve or disapprove; if no response within 10 days, approval is not required as long as the design is in harmony with existing structures and complies with restrictions.
- Utilities & drainage: Sewerage must meet NC Board of Health regulations. Water for human consumption must come from individual wells unless other sources are approved. Each owner must install and maintain a culvert/drainage pipe under their driveway (min 12-inch diameter, 18 ft length) with masonry retaining walls to prevent erosion.
