Deer Run Subdivision is a single-family home community in Wilmington, NC, governed by a set of covenants, conditions, and restrictions (CC&Rs) recorded in 1984. These rules apply to all owners, their assignees, lessees, and guests, and cover architectural standards, landscaping, drainage, animals, and enforcement.
- Architectural standards: Homes must have at least 1,300 sq ft of heated living area, a maximum of two levels plus a loft (or any combination with a first level of at least 1,000 sq ft excluding garages/accessories), and a height limit of 35 feet above finish grade. Exterior finishes should be wood, stone, brick, brick veneer, or wood siding (aluminum/vinyl allowed if reviewed and found high quality). Design must be in good taste and reviewed by existing property owners or their agent. No mobile homes, trailers, or prefabricated homes are permitted; recreational vehicles may be parked for up to two months for visiting guests. Exterior construction must be completed within one year of building permit issuance. No junk or abandoned vehicles may be stored on any tract.
- Landscaping & buffers: Property line buffer zones of 25 feet on each side must retain existing trees (undergrowth may be trimmed). Residences and structures must be set back at least 50 feet from adjacent roads, drives, and adjoining properties. During construction, owners must preserve natural tree growth and minimize clutter. Lots may be subdivided into a minimum of 1.50 acres per lot, subject to local regulations and these covenants.
- Drainage & right-of-way maintenance: All ditches must conform to codes and be kept clear; property owners are responsible for maintenance and expense of ditches on their tract, with meetings to determine need and timing. Until the right-of-way is dedicated to the state, it is for private use by property owners, their assignees, lessees, and guests of Class B homeowners. Emergency, utility, and maintenance vehicles are permitted; unnecessary large vehicles are not. The right-of-way must be kept free of parked or abandoned vehicles. Class B homeowners using the right-of-way share upkeep costs on a pro-rata basis. No right-of-way work may begin without notifying Class B property owners. Common area right-of-way must have a mechanically graded road bed with a maximum 4-inch stabilized marl base.
- Animals & pets: Small animals are permitted as long as they do not cause harm from excessive noise, odor, or injury, and must be contained on the owner's property. Large domestic animals are allowed at one per acre, provided they are well kept and yards are clean. Small farm animals (chickens, ducks, geese, etc.) are permitted except swine, as long as they do not cause harm. If any animal causes concern, a meeting of property owners may be called to address the issue.
- Enforcement: All property owners have the right to enforce these covenants against any other owner intended to be bound, by any lawful means including injunctions and monetary damages.
- Amendments: Modifications or amendments to these restrictions require a two-thirds vote of property owners in Section 1, Tracts 2, 3, 4, and 6. Tract 1, if later subdivided as Section 2, does not vote on further subdivision of Section 1 but may vote on modifications that affect Section 2.
