North Hills is a standard single-family home subdivision in Wilmington, NC. These restrictive covenants run with the land and bind all current and future lot owners. They set rules for residential use, minimum house size, setbacks, outbuildings, pets, and vehicle storage.
- Residential use only: Lots may be used only for residential purposes. No temporary structures, trailers, mobile homes, tents, shacks, garages, or barns may be used as a residence.
- Minimum house size: Single-story homes must have at least 1,600 square feet of living area on the ground floor. Two-story or taller homes must have at least 900 square feet on the main floor.
- Setbacks & lot size: Front setback: 40 feet from front property line. Side setback: at least 10 feet. Rear setback: at least 25 feet. No lot may be re-subdivided to less than 60 feet width at the front building line or less than 20,000 square feet.
- Outbuildings & fences: Outbuildings are allowed only behind the rear line of the existing home, limited to one pump house and one utility building made of the same exterior materials as the main dwelling, and must be approved in advance. Boundary fences may not exceed 5 feet in height and must be professionally installed.
- Pets & animals: No hogs, goats, horses, or like animals. Cats and other household pets are allowed. Dogs must be fenced in or leashed, and limited to two per lot. Nuisance dogs are not permitted.
- Parking & vehicles: Vehicles other than family cars must be parked in the rear of the lot. No junk, cars or parts of cars may be openly stored. Travel trailers must be kept behind the residence.
- Yard maintenance & trash: Yards must be kept clean and reasonably groomed. Trash must be stored in sanitary containers, kept in the rear of the residence except on pick-up days. No dumping.
- Duration & amendment: These covenants run with the land until February 1, 1974, and automatically extend for successive 10-year periods unless a majority of lot owners agree to change them.
