What Castle Cove's governing documents say
Castle Cove is a single-family home subdivision in Castle Hayne, NC, governed by a homeowners association (HOA). The rules apply to all lot owners and are designed to maintain the residential character and natural environment of the community.
- Residential use & lot use: All lots are for single-family residential use only. No temporary structures (trailers, tents, etc.) are allowed, except contractor shelters during construction for up to 9 months. Lots cannot be subdivided without the developer's consent.
- Architectural review & construction: All building plans, site improvements, and alterations (including fences, walls, piers, and grading) must be approved in writing by the developer (or its successor) before construction. The developer has sole discretion to approve or deny plans. Minimum heated floor area is 1,500 sq ft; maximum building footprint is 15% of lot area. Buildings cannot exceed 2 stories. Plans must be designed by a registered architect unless the developer waives this requirement.
- Setbacks & building location: Buildings must be at least 15 ft from side property lines and 25 ft from subdivision road rights-of-way. Roof overhangs may extend up to 4 ft over the side setback. Waterfront lots require at least 25 ft setback from water or canal, except for bulkheads, piers, and boathouses.
- Sewage system: The community has a private communal sewage system owned and operated by the HOA. Each lot owner must maintain the septic tank and pump components on their lot. Septic tanks must be checked and cleaned at least every 3 years (or every year if a garbage grinder is used). The HOA has an easement to access lots for inspection and repair.
- Parking & driveways: Each lot must provide off-street parking for at least 2 automobiles before occupancy. Only one driveway per lot is allowed (loop driveways with two street accesses are acceptable). Driveways must be gravel, asphalt, or concrete.
- Native growth & landscaping: Native trees, shrubs, marsh grasses, and other vegetation cannot be destroyed, removed, or planted without prior written approval from the developer. No alterations of marshland are permitted. The developer may require replanting at the owner's expense.
- Piers, docks & boat ramp: Piers, bulkheads, and boathouses require approval from state/federal authorities and the developer. Only one floating dock and ramp per waterfront lot is allowed. Structures cannot protrude more than 3 ft into the water. Piers and docking facilities are for the exclusive use of Castle Cove property owners and cannot be rented or used for live-aboard boats. The boat ramp is for subdivision property owners, their lessees/tenants, and certain named individuals, on a first-come, first-served basis.
- Maintenance & nuisances: Lots must be kept clean and free of rubbish. No obnoxious or offensive activities, excessive noise, foul odors, or anything that disturbs the peace are allowed. Owners must maintain their residences and grounds to avoid unsightly conditions.
