What Highland Dunes's governing documents say
Highland Dunes is a single-family residential subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1972. These covenants run with the land and apply to all lot owners, covering permitted structures, architectural approval, maintenance, and use restrictions.
- Permitted structures: Each lot may have one detached single-family dwelling (max 2.5 stories), one mobile home, and incidental outbuildings (garages, storage, etc.). Campers and travel trailers are allowed only on the rear 30 feet of the lot with written approval and cannot be used as residences.
- Mobile home requirements: Mobile homes must be at least 10 feet wide (unless a variance is approved), must be skirted, and plans/materials must be approved in writing. All structural additions or alterations also require prior written approval.
- Architectural review: Plans and materials for all structures (dwellings, mobile homes, outbuildings, fences, and any alterations) must be approved in writing before construction. If the approving party fails to respond within 10 days of receiving sufficient information, the plans are automatically approved.
- Maintenance & nuisances: All structures must be kept in good repair. Damaged or dilapidated buildings may be removed at the owner's expense. No unlicensed or inoperable vehicles, junk, trash, or debris may accumulate. Yards must be properly maintained.
- Setbacks & lot use: Structures must be at least 25 feet from the front property line and 10 feet from side property lines. Corner lots use the shorter street frontage as the front line. Lots cannot be resubdivided except to merge with an adjacent lot.
- Pets & animals: No livestock, poultry, or other animals except household pets. Pets must be kept on a leash, inside the home, or in a fenced area.
- Commercial & signs: No commercial activity is allowed on any lot. Signs are limited to 'For Sale' or 'For Rent' signs no larger than 2 feet by 3 feet, plus builder signs during construction.
- Duration & amendment: These covenants run until January 1, 2000, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them.
