Bridgewater Bluffs, Phase II is a single-family home HOA in Wilmington, NC. These covenants, conditions, and restrictions (CC&Rs) run with the land and bind all lot owners, their heirs, successors, and assigns. The document establishes the HOA, common areas, assessments, use restrictions, and stormwater management requirements.
- What you own & maintain: You own your lot and the residence on it. The HOA owns and maintains the common areas, including streets, entrance ways, retention ponds, and stormwater facilities. You must maintain your lot and prevent unsightly conditions.
- Architectural review: All exterior construction, additions, or alterations (including fences, walls, and landscaping) require prior written approval from the Declarant or its architectural committee. Plans must be submitted; if not approved or disapproved within 30 days, approval is deemed given. Minimum residence size is 1,500 heated square feet (exclusive of porches, garages, etc.). Maximum height is 2.5 stories. Exterior materials must be conventional frame, wood siding, or brick; no concrete block, aluminum siding, or composition tar paper. Minimum double-wide concrete driveway required. Built-upon area per lot limited to 4,000 square feet (excluding wood decking).
- Leasing & rentals: Leases must be for at least 12 consecutive months. All leases must comply with HOA rules and regulations.
- Pets: Dogs, cats, or other household pets are allowed, but not for commercial purposes. They must be leashed and not allowed to run free. No livestock, pigs, or poultry.
- Parking & vehicles: No boats, motor boats, dune buggies, campers, trailers, recreational vehicles, automobiles on cinder blocks, tractor-trailer trucks or cabs, or similar vehicles may remain on any lot without HOA or Declarant consent.
- Fences & landscaping: Fences, walls, or hedges over 5 feet in height are prohibited without written consent. Fences must be wood, stained to match the house; no stucco, chain link, or wire fences. No fence closer to the front lot line than the rear corner of the dwelling. Large trees or natural foliage may not be removed without prior written approval.
- Stormwater management: Each lot must maintain a 30-foot vegetated buffer between impervious areas and surface waters. Built-upon area per lot is limited to 7,300 square feet (including certain right-of-way areas). Roof drains must terminate at least 30 feet from mean high water mark. No filling or piping of vegetative conveyances except driveway crossings. The HOA owns and must maintain all stormwater facilities.
