Garden Place is a single-family home subdivision in Wilmington, NC, governed by a 1965 declaration of covenants that run with the land. These rules apply to all lot owners and future owners, preserving the area for residential use.
- Land use & building type: All lots are for residential use only; no commercial activity. Only one detached single-family dwelling per lot, no more than 2½ stories, plus a one- or two-car garage.
- Setbacks & minimum size: Buildings must be at least 50 feet from the front lot line, 10 feet from side lines, and 10 feet from the rear line. Each residence must have at least 1,200 square feet of living area.
- Prohibited structures & uses: No trailers, basements, tents, shacks, garages, garage apartments, barns, or other outbuildings may be used as a residence (temporary or permanent). No noxious or offensive activities or nuisances.
- Architectural review: Plans and specifications for all buildings must be approved by the developer (or heirs/assigns). Lots cannot be subdivided without similar approval.
- Sewerage: Until municipal sewer is available, sewerage disposal must be by septic tank approved by the North Carolina State Board of Health.
- Duration & amendment: Covenants run with the land until January 1, 1975, then automatically renew for successive 10-year periods unless a majority of lot owners vote to change them.
- Enforcement: Any lot owner may sue to enforce the covenants, seeking to prevent violations or recover damages. Invalidating one covenant does not affect the others.
