Shearin Hills is a single-family home subdivision in Wilmington, NC. These covenants run with the land and bind all lot owners. The rules cover residential use, building setbacks, minimum house size, and restrictions on businesses, pets, signs, and fences.
- Residential use only: All lots are for single-family detached dwellings only. No business, trade, professional office, fraternity, rooming house, boarding house, antique shop, or gift shop is allowed. No noxious or offensive activities.
- Building setbacks & height: Dwellings must be at least 30 feet from the front lot line, 25 feet from the rear, and no closer than 10% of the average lot width from side lines. Maximum height is 2½ stories. On corner lots, the shorter street frontage is considered the front.
- Minimum house size: The main dwelling must have at least 950 square feet of heated floor area, excluding garages, carports, and porches.
- Outbuildings & fences: No unattached garages. Outbuildings, playhouses, and dog houses must be at least 50 feet from the front lot line, 10% of lot width from side lines, and 10 feet from the rear line. Fences cannot exceed 48 inches in height and must be set back from the street to at least the front of the house.
- Pets: Only household pets are allowed. Dog kennels and keeping animals for commercial purposes are prohibited.
- Vehicles & storage: No trucks, tractors, or inoperable automobiles may be stored or regularly parked on the premises. No storage of trade materials or inventories.
- Signs: Only one sign of up to 5 square feet advertising the property for sale or rent is allowed, plus builder signs during construction and sales.
- Utilities & easements: Easements for utilities and drainage exist as shown on the plat and over the rear 10 feet of each lot. No structures or plantings that interfere with utilities or drainage are allowed. Lot owners must maintain easement areas. Until public sewer is available, septic tanks must meet state health board approval. Household water must come from Quality Water Supplies, Inc.; separate outdoor water systems require written approval.
