Townes at Marketplace is a planned community of townhomes in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that applies to all lot owners, residents, and guests. It covers what you own, what the HOA maintains, architectural rules, use restrictions, assessments, and stormwater/sewer obligations.
- What you own & maintain: You own your lot and the townhome on it. The HOA maintains common elements (roads, stormwater ponds, open space) and limited common elements (exterior of dwellings, driveways, yards). You must keep your lot free of weeds and debris, and maintain shrubs and sod in your limited common area.
- Architectural review: No exterior changes (including painting) may be made without written approval from the Declarant or later the HOA's Architectural Control Committee. Plans are deemed approved if no response within 30 days. Minimum dwelling size is 1,200 heated square feet. Exterior must be completed within 12 months of starting construction.
- Use restrictions: Lots are for single-family townhome residential use only. No boats, campers, trailers, inoperable vehicles, or commercial vehicles may be parked on lots or streets. Parking is limited to two cars on the driveway and one in the garage. No fences, clotheslines, or temporary structures without approval. Only one small 'for sale/rent' sign is allowed in the front bedroom window.
- Pets: Domestic dogs and cats are allowed but must be leashed and not become a nuisance. No animals for commercial purposes. Pets cannot be confined to screened porches permanently.
- Assessments & fees: Each lot owner pays annual assessments, plus possible special assessments, insurance assessments, and a one-time working capital assessment (equal to one quarter of the annual assessment). Unpaid assessments accrue interest and become a lien on the lot. The HOA can foreclose on the lien after 30 days delinquency.
