Barton Oaks Subdivision is a standard single-family home HOA in Wilmington, NC. These restrictive covenants run with the land and bind all current and future lot owners.
- Residential use only: Lots may only be used for residential purposes. No commercial trade, professional offices, fraternity houses, rooming/boarding houses, antique or gift shops are allowed.
- Single-family dwellings: Only one detached single-family dwelling (max two stories) plus incidental outbuildings (servant's quarters, swimming pools) are permitted per lot. No trailers, mobile homes, motor homes, tents, shacks, garages, or barns may be used as residences.
- Minimum square footage: The main dwelling must have at least 1,200 square feet of heated floor area, excluding garages, carports, porches, and outbuildings.
- Setback requirements: Dwellings must be at least 25 feet from the front lot line and 10 feet from side lot lines. Eaves may overhang up to 3 feet, and uncovered stoops/steps are allowed within the setback.
- Architectural review: Plans for all dwellings and structures (including fences, swimming pools, outbuildings, garages) must be approved by the developer (Southwoods Development Co., Inc.) or its successors. If no response within 20 days of submission, plans are deemed approved if in general conformity with other structures.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock may be kept. Dogs, cats, and other household pets are allowed but not for commercial purposes, and not in numbers or of a nature that becomes a nuisance.
- Vehicles & signs: Unsightly, inoperative junk cars and similar eyesores are prohibited. Only one sign (max 5 square feet) advertising the property for sale or rent is allowed, plus builder signs during construction.
- Maintenance & debris: All buildings must be kept in suitable repair. After fire or casualty, debris must be cleared within 90 days. No dumping of rubbish, trash, or garbage except in sanitary containers. Yards may be cleaned by the developer at the owner's expense if not properly maintained.
