What Kaylie's Cove's governing documents say
Kaylie's Cove is a planned community of single-family homes in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners, residents, and their guests. It covers property rights, assessments, architectural controls, and use restrictions for the subdivision.
- What you own & maintain: You own your lot and dwelling in fee simple. The HOA owns and maintains the common areas (sidewalks, streets, recreation areas, stormwater systems) and carries insurance on them. You must maintain your own property and pay assessments for common expenses.
- Assessments & fees: All lot owners pay annual assessments set by the HOA board, plus possible special assessments. Assessments are uniform per lot. There is also an initial capital contribution of one-fourth of the annual assessment due at closing. Late payments incur interest at 18% per year and can become a lien on the lot.
- Architectural review: No exterior changes (including paint, fences, sheds, landscaping) may be made without prior written approval from the Declarant or, after surrender, the HOA board or architectural review committee. Plans must be submitted and approved within 60 days. The HOA may charge a fee for review.
- Leasing & rentals: The document does not restrict lease terms or require owner occupancy. Tenants may use common areas if the owner assigns that right, but the owner then forfeits their own use during the tenancy.
- Pets: The document does not contain specific pet restrictions. The HOA may adopt rules and regulations regarding pets.
- Use restrictions: Lots are for single-family residential use only. No structure, planting, or material may interfere with utility easements. Political signs are regulated (as noted on the first page). The HOA can suspend voting rights for up to 60 days for rule infractions.
- Common area access: All owners have an easement to use common areas, subject to HOA rules. The HOA may charge fees for recreational facilities and limit use to owners, their families, tenants, and guests. The HOA can also open common areas to non-members.
- What this document doesn't cover: This document does not specify age restrictions, rental caps, parking rules, or specific pet limits. Those may be addressed in separate HOA rules and regulations.
