Upper Reach is a single-family home HOA in Wilmington, NC. This declaration governs Phase I and binds all lot owners, their tenants, and guests. It establishes the association, architectural controls, use restrictions, and assessment obligations.
- What you own & maintain: You own your lot and the single-family dwelling on it. The association maintains common areas (limited to the 50-foot right-of-way of Upper Reach Drive, part of McKenzie Drive, and other designated areas), the stormwater drainage system, and planting easements. You must maintain your own structures and lot, and you grant the association access for utility and drainage repairs.
- Architectural review: No structure, fence, wall, or exterior alteration may be built without prior written approval from the Declarant (or later the Board/architectural committee). Plans must be submitted; approval may be denied for any aesthetic or environmental reason. If no decision within 20 days, approval is deemed given. Minimum enclosed dwelling area is 1,800 square feet (excluding garages, decks, open porches). No house may exceed 2.5 stories. Setback: at least 10 feet from adjoining property lines. Exterior completion required within 12 months of start.
- Landscaping & trees: No tree over 3 inches in diameter (measured 1 foot above ground) may be removed without prior written approval based on a submitted site/landscaping plan. This restriction expires 20 years from the declaration date (July 31, 2009).
- Use restrictions: Lots are for single-family residential use only. No commercial activity, noxious activities, or nuisances allowed. Temporary structures, trailers, mobile homes, tents, and recreational vehicles (campers, motor homes) are prohibited without written consent. No inoperable or unregistered vehicles, and no tractor-trailers. No outside radio/TV antennas without permission. Exterior lights must be clear, white, or non-frost bulbs.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. No livestock or poultry.
- Assessments & fees: Annual assessments are set by the Board; may increase up to 5% per year without a membership vote, or higher with 2/3 vote. Initial maximum annual assessment is $200 per lot. Special assessments for capital improvements require 2/3 member approval. Assessments are a lien on the property and a personal obligation of the owner. Unpaid assessments bear interest at the highest legal rate. The association may sue or foreclose.
