Whisper Creek Subdivision is a single-family home community in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and are designed to maintain a uniform residential character.
- Residential use only: All lots are for single-family residential use only; no commercial activity is allowed. Only one detached single-family dwelling (max 2.5 stories) and a private garage for up to two cars may be built per lot.
- Setback requirements: Buildings must be at least 60 feet from the front street line and at least 10% of the lot's frontage width from side property lines. For corner lots, the side with less street frontage is considered the front.
- No temporary structures: House trailers, mobile homes, tents, shacks, and temporary residences are prohibited. No temporary structure or trailer may be placed on any lot.
- Nuisance & property maintenance: No noxious or offensive activity is allowed. Lot owners must prevent unclean, unsightly, or unkempt conditions. Inoperative cars are not permitted on any lot.
- Architectural review: Plans for any dwelling must be approved by the Declarant (or its agents) before construction. Approval or disapproval must be given within 10 days of a written request; if no response, approval is not required as long as the design is in harmony with existing structures.
- Minimum dwelling size: Each dwelling must have at least 2,000 square feet of interior living space (excluding porches, garages, etc.). The Declarant may approve a dwelling up to 10% smaller if it fits the subdivision's character.
- Exterior materials & fences: Dwellings must be constructed of wood, brick, brick veneer, or stone. Garages and outbuildings must use similar materials. Fences are allowed only behind the rear of the dwelling; no fences closer to the street than the rear of the house.
- Prohibitions on wells, satellite dishes & antennas: Private water wells are prohibited without written permission from Cape Fear Utilities. Satellite dishes and exterior antennas of any type are not allowed on lots or structures.
