What Caneel Cove's governing documents say
Caneel Cove is a townhouse development in Wilmington, NC, governed by a homeowners association. Owners own their lot and townhouse, share common areas, and pay assessments for maintenance and insurance. The document establishes rules for property use, architectural control, and party wall responsibilities.
- What you own & maintain: You own your lot and townhouse. The association maintains the exterior of all structures (including townhouse units) and common areas. You must keep your lot and unit neat; if you fail, the association may step in and charge you.
- Architectural review: No building, fence, wall, or exterior change (including landscaping) may be made without written approval from the developer or later an Architectural Control Board. Plans are deemed approved if not acted on within 60 days. Approval may be denied for any reason, including aesthetics.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared by the owners who use the wall in proportion to use. Disputes are resolved by arbitration.
- Assessments & fees: Annual assessments start at a maximum of $1,000 per lot, adjustable up to 5% yearly without a vote. Special assessments for capital improvements require a two-thirds vote. Unpaid assessments become a lien on the property and bear 6% interest.
- Property use restrictions: Lots are for residential use only. No business, noxious activities, above-ground utilities, signs (except approved name/sale signs), temporary structures, trailers, clotheslines visible from common areas, or exterior antennas are allowed. Window coverings visible from outside must be white or neutral.
- Common areas & amenities: Common areas include yards, roads, walkways, parking, and utility installations. Owners have an easement to use them, but the association can suspend use for unpaid assessments or rule violations (up to 60 days). The association may charge fees for recreational facilities.
- Insurance: The association must carry property and liability insurance (at least $1,000,000 per occurrence) on common areas and structures. Premiums are a common expense. Policies must include waivers of subrogation and cannot be cancelled without 30 days' notice.
- What this document doesn't cover: This excerpt does not specify pet limits, leasing restrictions, age restrictions, or parking rules beyond general common area use. It also does not include current assessment amounts or detailed rules for specific recreational amenities.
