What Suncourt Villas's governing documents say
SunCourt Villas is a patio home development in Wilmington, NC, governed by a homeowners association (HOA). It consists of single-family patio homes and duplexes on individually owned lots, with shared common areas maintained by the association. This document is the full declaration of covenants, conditions, and restrictions that apply to all lot owners.
- What you own & maintain: You own your lot and the patio home on it. You are responsible for maintaining your structures and grounds in a neat condition. The association maintains the common areas (e.g., roads, walkways, lighting) and may perform exterior maintenance if you fail to do so after notice.
- Architectural review: No building, fence, wall, or other structure may be built or altered without prior written approval from the Developer (initially) or an Architectural Control Board (after Developer control ends). Plans must be submitted and approved within 60 days, or they are deemed approved. Approval may be denied for any reason, including aesthetics.
- Residential use & restrictions: All lots must be used for residential purposes only. No business activity, noxious activities, or nuisances are allowed. Temporary structures, trailers, mobile homes, and above-ground utilities are prohibited. Clotheslines visible from common areas or adjoining lots are not allowed.
- Pets & animals: Only household pets are permitted; no poultry, livestock, or other animals are allowed. No specific pet limit is stated.
- Leasing & rentals: The document does not address leasing or rental restrictions. Owners may delegate their common area use rights to tenants.
- Parking & vehicles: Each lot must provide two on-site parking spaces. No more than two spaces are allowed within the 20-foot front setback area. Parking rights in common areas may be delegated to tenants or invitees.
- Assessments & fees: Annual assessments are set by the Board, uniform per lot, and must be at least $100 per year. A one-time reserve fund payment of $100 is required upon purchase from the Developer. Special assessments for capital improvements require a two-thirds vote of members. Assessments are a personal obligation and a lien on the lot.
- Patio home design standards: Patio homes must be at least 1,000 square feet. Ground floor area cannot exceed 50% of lot area for one-story homes or 40% for two-story homes. Height is limited to two floors. Setbacks: 20 feet front, 10 feet side (opposite zero lot line), 20 feet rear for duplexes. Patio walls must be 6–7 feet high and are the owner's responsibility.
