Westchester Subdivision is a single-family home HOA in Wilmington, NC. These restrictive covenants run with the land and bind all current and future lot owners. The document sets rules for residential use, building size and placement, and property maintenance.
- Land use & building type: Lots are for residential use only. Only one detached single-family dwelling (max 2 stories) and a private garage (max 1 story, no living quarters) are allowed. No temporary structures, trailers, mobile homes, tents, or outbuildings may be used as residences.
- Minimum dwelling size: Each dwelling must have at least 900 square feet of heated living area, excluding porches, garages, and carports.
- Setbacks & building lines: Buildings must be at least 25 feet from front or side street lines, and at least 10% of the lot width from side lot lines. Eaves overhanging up to 3 feet and uncovered stoops/steps are allowed within setbacks.
- Architectural review: Plans for all dwellings and structures must be approved by the developer (Traco Development Company) or its successor. If no response is received within 20 days of submission, plans are deemed approved as long as the structure is in general conformity with others in the subdivision.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, or other household pets are allowed but not for commercial purposes, and must not become a nuisance.
- Vehicles & parking: No inoperative junk cars or eyesores may be kept on any lot or street. Fences or obstructions cannot extend nearer the street than the rear line of the main dwelling.
- Nuisance & maintenance: No commercial, noxious, or annoying activity. Yards must be properly maintained; the developer may clean them at the owner's expense. Rubbish must be kept in sanitary containers. Buildings must be kept in good repair; debris from fire or casualty must be cleared within 90 days.
- Signs: Only 'For Sale' or 'For Rent' signs are allowed, not exceeding 2 feet by 3 feet.
