Magnolia Plantation Subdivision is a single-family home HOA in Wilmington, NC. These covenants and amendments bind all lot owners and set rules for residential use, construction, and property maintenance.
- Residential use only: All lots are for single-family residential use only. No temporary structures, trailers, tents, or barns are allowed. No business or commercial activity, including renting apartment space, may be conducted on a lot.
- Minimum house size: As amended in 2010, a one-story dwelling must have at least 2,200 heated square feet on the ground floor. A dwelling of more than one story must have at least 1,200 heated square feet on the ground floor and a total of at least 2,200 heated square feet. The Board may vary these requirements by up to 10% in writing.
- Architectural review: No building, fence, wall, or other structure may be erected or altered, and no grading or change to the lot's physical characteristics may be made, without prior written approval from the developer (MLDC) or its successor. Plans must include exterior design, colors, finishes, site and grading plans, and a construction schedule. Approval may be based on any ground, including aesthetic considerations.
- Construction timeline: The exterior of all houses and other structures must be completed within 12 months after construction begins, unless delayed by strikes, fires, national emergency, or natural calamities. If not completed, MLDC has the option to repurchase the lot at the original selling price, subject to any mortgage liens.
- Impervious cover limit: No more than 4,268 square feet of any lot may be covered by structures or paved surfaces (including walkways, driveways, patios) to comply with North Carolina coastal stormwater regulations. MLDC may recalculate this limit if required by state rules.
- Parking & vehicles: Each lot must provide off-street parking for at least three automobiles before occupancy. As amended in 2020, no recreational vehicles, cars, trucks, trailers, boats, campers, or similar vehicles may be parked on subdivision streets; street parking is limited to temporary visitors.
- Pets: Only usual household pets are allowed. No other animals may be kept on any lot.
- Fences & pools: No wire, chain link, or metal fences are allowed. Fences or walls must be wood, brick, or stucco and cannot be placed nearer to the street than the rear line of the main dwelling unless approved in writing. As amended in 2020, no above-ground pools are permitted, and any fence must be of vinyl material unless the Architectural Control Committee agrees otherwise.
