Shell Island Village is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). These covenants run with the land and bind all current and future lot owners. The HOA maintains private streets, water/sewer lines, walkways, and boardwalks.
- Residential use only: Lots must be used exclusively for residential purposes, with no more than one residence per lot. No commercial activity, hotels, motels, or boarding houses are allowed.
- Architectural review: All construction, improvements, or alterations require prior written approval of the Declarant (or its successors/assigns), based on submitted plans and specifications. Approval may be denied for any reason, including aesthetic or environmental grounds. Fencing also requires approval.
- Minimum dwelling size: The enclosed dwelling area (excluding porches and garages) must be at least 1,600 square feet for a one-story home and 2,000 square feet for a two-story home.
- Construction timeline: Exterior construction must be completed within 12 months of commencement, unless delays are caused by strikes, fires, national emergencies, or natural calamities. No structure may be used as a residence until the exterior is finished and sanitary facilities are operational.
- Pets: Dogs, cats, and other household pets are allowed, but not for breeding or commercial purposes. The Association may adopt additional rules regarding pets.
- Signs: Only one sign per lot is allowed, up to 5 square feet, advertising the property for sale or rent. Owner identification signs up to 2 square feet are also permitted. Signs used by the Declarant for lot sales are allowed.
- Maintenance and nuisances: All buildings must be kept in good repair. Debris from fire or casualty must be cleared within 90 days. No obnoxious or offensive activity is permitted. Utility equipment, fuel tanks, clotheslines, woodpiles, and trash must be screened from view.
- Duration and amendments: These covenants run until January 1, 2005, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them. Amendments may be made at any time by a majority vote of HOA members.
