Pharma Office Park is a condominium community in Wilmington, NC, restricted to non-residential office and institutional use. This document is the full Declaration of Condominium, which creates the condominium and governs unit owners, the association, and the developer's rights.
- Use restrictions: All units are restricted to general office and professional use (e.g., medical, dental, legal, banking) and may not be used for residential purposes. Additional uses may be permitted by the Declarant or the Board.
- What you own & maintain: You own the interior of your unit (including HVAC systems serving it exclusively). The association maintains all common elements, including exterior surfaces, parking areas, and walkways. Limited common elements (e.g., exterior doors, windows, signage) are assigned to specific units, and their maintenance costs are assessed to those units.
- Leasing & rentals: All leases must be in writing and comply with the condominium documents. Leases are deemed to include a provision that the tenant attorns to the association for enforcement of rules, after the association gives the landlord notice and a chance to cure.
- Architectural review: No structural additions, alterations, or changes to the exterior appearance of a unit or common elements may be made without prior written approval from the Executive Board. Interior alterations that do not impair structural integrity or mechanical systems are allowed without approval.
- Signage: Unit owners may affix letter signage of an approved size only to the exterior door serving their unit. No exterior signs are allowed without board consent. For-sale signs are limited to one 3x3 sign inside the front window.
- Parking & vehicles: Parking is provided in surface spaces as limited common elements or common elements. The association may adopt rules regarding parking, towing, and designation of spaces for owners, tenants, and visitors.
- Assessments & fees: Annual and special assessments are levied per unit based on the allocated interest (percentage of common expense liability) shown on Exhibit B. Assessments cover maintenance, insurance, utilities, trash service, and other common expenses.
- Developer rights: The Declarant retains development rights to add units, common elements, and limited common elements for up to 10 years after recording. During the Declarant Control Period, the Declarant may appoint board members and exercise other special rights, including maintaining sales offices and signs.
