What Regency Court's governing documents say
Regency Court is a single-family home community in Ogden, NC, governed by a homeowners' association (HOA) under the North Carolina Planned Community Act. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners. It covers property rights, architectural standards, assessments, and use restrictions.
- What you own & maintain: You own your lot and home. The HOA maintains common areas and landscaping on lots (except courtyards and enclosed pool areas, which you maintain). You must maintain your home and lot to avoid unsightly conditions.
- Architectural review: All exterior improvements or modifications require prior approval from the Declarant (during the developer control period) or the Architectural Review Committee (ARC) after that. Disapproval can be based on any grounds the ARC deems sufficient, but approval cannot be unreasonably withheld.
- Assessments & fees: All lot owners pay annual assessments, and may also pay special, insurance, ad valorem tax, and working capital assessments. The first working capital assessment is $200. Assessments are equal for all lots. Unpaid assessments accrue interest and can become a lien on the lot.
- Use restrictions: Lots are for single-family residential use only. No boats, campers, RVs, or inoperable vehicles may be stored on lots or streets. Only standard passenger vehicles (including passenger vans and pickups) may be parked, and they must have current tags and be in operating condition. No garage doors may be left open overnight.
- Pets: A reasonable number of dogs, cats, or other household pets are allowed, but not for commercial purposes. Pets must be leashed or controlled on your lot and must not become a nuisance. Owners must clean up pet waste.
- Leasing & rentals: The document does not address leasing or rental restrictions. (No minimum lease term or rental cap is mentioned.)
- Construction standards: Each home must have at least 2,300 square feet of enclosed, heated dwelling area (excluding garages, decks, etc.). Vinyl or aluminum siding and asphalt driveways are prohibited. Sidewalks must be installed and maintained by the lot owner during construction.
- Developer rights: The developer retains significant rights until the last lot is sold or 2012, including the right to amend the declaration, annex additional property, and control the architectural review committee. The developer is exempt from assessments during development.
