Landfall Business Center is a commercial office park in Wilmington, NC, governed by a Declaration of Covenants, Conditions, and Restrictions. This document establishes the Commercial Section 1B at Landfall Owners Association, which maintains common areas (including private roads, detention ponds, and a sewer disposal system) and levies assessments on lot owners. It applies to owners and occupants of Lots A–E, as well as potential affiliate members who use the disposal system.
- What you own & maintain: You own a numbered lot (A–E) shown on the recorded plat. The association owns and maintains common areas (private roads, detention ponds, directory signage, the disposal system). Lot owners are responsible for maintaining gravity sewer lines within their lot boundaries.
- Assessments & fees: Annual assessments for common area maintenance start at $2,400 per vote per lot (with votes per lot: A=2, B=1, C=1, D=1, E=1). Disposal system annual assessments are allocated by percentage (A=27%, B=14%, C=14%, D=22.5%, E=22.5%). Special assessments for capital improvements require majority vote of voting members; disposal system special assessments do not require member approval. Late fees of $100/month (max $1,200) and 12% annual interest apply to unpaid assessments.

- Common area use & restrictions: Owners have an easement to use common areas, subject to association rules and fees. The association may suspend voting rights for unpaid assessments or rule infractions. Common areas may be dedicated to a public agency with approval of two-thirds of voting members and declarant (while declarant controls the board).
