Westfall Park is a planned community in Wilmington, NC, governed by a homeowners' association (HOA). This declaration applies to all lot owners and residents, and it establishes rules for land use, architectural control, assessments, and maintenance. The community is zoned for office and retail use, not residential.
- Land use & building type: Lots may only be used for office and retail purposes, unless the developer authorizes another use during the Declarant Control Period. No residential use is permitted.
- Architectural review: All exterior construction, additions, or alterations (including painting) require prior written approval from the Declarant, the Board, or an Architectural Control Committee. Approval may be denied for any reason, including aesthetics. Plans are deemed approved if no response is given within 30 days.
- Minimum construction standards: Exteriors must be masonry, stucco, and/or glass. Buildings must be set back 50 feet from street rights-of-way (30 feet for lots under 250 feet deep) and 15 feet from other boundaries. Construction must be completed within 24 months. Built-upon area on each lot is limited to 85% of the lot area.
- Assessments & fees: Annual assessments are based on lot square footage. Special assessments for capital improvements require a majority vote of members. Assessments become a lien on the lot if unpaid for 30 days, and the Association may foreclose. Late fees and interest apply.
- Use restrictions: No noxious or offensive activities, temporary structures, or signs (including for-sale signs) are allowed without permission. Lots may not be subdivided without consent. Owners must keep lots free of weeds, debris, and unsightly conditions.
- Maintenance responsibilities: Each lot owner must maintain their lot, including exterior structures, parking areas, sidewalks, and landscaping. The Association may enter a lot to remedy violations after 30 days' notice and charge the owner.
- Enforcement & fines: The Association may impose fines for violations, suspend services and privileges (except access to lots), and add unpaid fines to the annual assessment. The Association may also file a lien and foreclose for unpaid assessments.
