What 1606 S Mackerel Townhomes's governing documents say
1606 S MACKEREL Townhomes is a two-unit townhome community in Wilmington, NC, governed by a declaration of covenants, conditions, and restrictions (CC&Rs). This document binds all unit owners and outlines rules for residential use, maintenance responsibilities, and association governance.
- What you own & maintain: You own your unit and an undivided one-half interest in the common elements. Each unit owner is responsible for maintaining their unit's exterior, driveway, and limited common areas (e.g., decks). Roof replacement, the front landing, and the party wall are shared equally, unless damage is caused by one owner.
- Leasing & rentals: Units may be rented for residential purposes, but rentals of less than the whole unit are prohibited. No timeshares are allowed.
- Pets: Domestic household pets are permitted subject to association rules. Pets must be leashed outside, waste must be removed immediately, and excessive noise is prohibited. No commercial breeding or keeping of livestock is allowed.
- Architectural review: No exterior alterations, additions, or changes (including painting, fences, satellite dishes, or signs) may be made without the unanimous written consent of both unit owners. The exterior color of a unit cannot be changed unless the entire building's color scheme is changed, also requiring unanimous approval.
- Parking & vehicles: No campers, trailers, boats, or trucks larger than a standard 2-ton pickup may be parked on the property. Vehicles must display current inspection stickers, and tools or materials in overnight-parked vehicles must be kept out of sight.
- Assessments & fees: There are no regular assessments; common expenses are split equally between the two units as special assessments. Late payments incur a 4% late fee and 10% annual interest. Unpaid assessments become a lien on the unit and may be foreclosed.
- Governance & voting: Each unit has one vote in the association. Many decisions require unanimous consent of both owners. Disputes that cannot be resolved within 30 days go to binding arbitration under American Arbitration Association rules.
