This is a declaration of covenants, conditions, and restrictions (CC&Rs) for a single-family residential subdivision in Wilmington, NC, consisting of two divisions: Barbara Gurganus Division and C.N. Dunn Place Division. The rules apply to all lot owners and are intended to preserve property values and attractiveness.
- Residential use & building type: Each lot is limited to one detached single-family dwelling, no more than 2½ stories, plus customary accessory structures (e.g., a garage with guest quarters) that must match the main dwelling in materials, style, and color. No house trailers, mobile homes, tents, or temporary structures are allowed as residences.
- Pets & animals: Only dogs, cats, and other household pets are permitted; no horses, livestock, or poultry. Pets cannot be kept for commercial purposes.
- Vehicles & storage: Inoperative, stripped, or junked motor vehicles, boats, and utility trailers cannot be stored on the property. Boats, boat trailers, and recreational vehicles must be stored behind the rear of the house and screened from view.
- Nuisance & prohibited activities: No illegal, noxious, or offensive trade or activity is allowed. Any use that becomes an annoyance or nuisance to the neighborhood is prohibited.
- Trash & debris: Trash, ashes, garbage, and rubbish must not be dumped or accumulate. Each owner must provide screened garbage receptacles not generally visible from the street.
- Rebuilding after casualty: If a dwelling is destroyed by fire or other casualty, it must be rebuilt to at least 1,250 heated square feet, or all debris must be removed within 60 days and the lot restored to a sightly condition.
- Signs & advertising: No signs, billboards, or advertising structures are allowed, except typical 'for sale' signs and builder identification signs.
- Utility connections: All utility connections (water, electricity, gas, telephone, television) must be run underground from the property connection points to the dwelling.
