The developer retains significant control until a transition date (January 2025 or earlier).
- Community structure & developer control: The developer (Declarant) has broad powers to add land, create special districts, and control design review until Class B membership ends (January 2025 or when Class A votes equal Class B). After that, control transfers to the community association.
- Membership & voting: Every plot owner is a member of the community association. Class A members (owners other than Declarant) get one vote per property unit; Class B member (Declarant) gets three votes per unit until transition.
- Assessments & fees: The association can levy initial reserve assessments, annual assessments, special assessments for capital improvements, and user fees. Assessments are a lien on the plot and a personal obligation of the owner. Delinquent assessments bear interest at the maximum legal rate.
