Marquis Hills is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1970. These covenants run with the land and bind all current and future lot owners.
- Residential use & lot size: All lots except Lot 12 (community water system) are single-family residential. Minimum residence size is 900 square feet (exterior brickwork, excluding porches, garages, etc.).
- Construction & exterior materials: Exteriors must be conventional frame or clay brick; concrete block, asbestos siding, cinder block, and composition tar paper are prohibited. No manufactured or prefabricated homes allowed.
- Setbacks & building lines: No building shall be within 30 feet of the front property line or within 10% of the lot's front width of any side boundary. The developer may adjust setbacks up to 10% with adjacent owner consent.
- Temporary structures & vehicles: No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences. No inoperative junk cars or eyesores may be maintained on the property.
- Signs: Only private name plates and 'For Sale' or 'For Rent' signs are permitted; no other signs or billboards.
- Utilities & easements: All water must come from the community water system unless health authorities approve another source. An 8-foot radius around each water meter is an easement for maintenance.
- Animals & nuisance: No domesticated farm animals or fowls. No noxious or offensive trade or activity; yards must be properly maintained.
- Duration & amendment: Covenants run for 20 years from March 1970, then automatically renew for successive 10-year periods unless a majority of lot owners vote to revoke or amend.
