Kure Beach Villas is a condominium community in Wilmington, NC — you own your individual unit and share ownership of the building's common elements, which the association maintains and insures. The community has a maximum of 8 units, and units are for single-family residential use only. This document is the full declaration of condominium, so it covers ownership structure, use restrictions, maintenance responsibilities, and association governance.
- What you own & maintain: You own the interior of your unit (bounded by unfinished surfaces of walls, ceilings, floors). The association maintains common elements (foundations, roofs, exterior walls, stairways, yards, parking, utility lines) and limited common elements (decks, outside entries, driveways serving only your unit). You must keep your unit in good repair and comply with insurance requirements.
- Leasing & rentals: Rental of units is allowed, subject to association rules. Tenants are not permitted to keep pets or park boats on the property.
- Pets: Unit owners may keep dogs, cats, or other household pets (not for commercial purposes) if they are leashed and not a nuisance. The association can require removal of a nuisance pet. Tenants may not keep any pets.
- Parking & vehicles: No trailers, motor homes, or similar vehicles may be stored on the property except in designated areas. Unit owners may park a boat in front of their unit while occupying it, but boats cannot block entrances/exits. Boats may not be stored when the owner is not occupying the unit. Tenants may not park or store boats.
- Architectural review: No structural modifications or exterior alterations (including painting, antennas, signs) may be made without written board consent. No objects may be fixed to common or limited common areas (fences, plants, etc.) without board approval.
- Assessments & fees: Assessments are based on your unit's undivided interest in common areas. The board proposes an annual budget; assessments are payable quarterly unless the board decides otherwise. Delinquent assessments accrue interest at the maximum legal rate, plus late fees and collection costs, and create a lien on the unit.
- Insurance: The association carries master property and liability insurance (minimum $300,000 liability per occurrence) on common elements and limited common elements. You need your own insurance for personal property and unit improvements. Master policy proceeds are used to repair or rebuild after damage unless 100% of owners vote not to rebuild.
- Amendments & termination: The declaration can be amended only by unanimous vote of all unit owners. Termination requires a recorded instrument signed by all owners, with property either sold or held as tenants in common.
