Kure Dunes is a single-family home subdivision in Kure Beach, NC, governed by a Declaration of Restrictive Covenants that runs with the land. These rules apply to all lot owners in Phase IV (Lots 1–40) and are enforced by the Kure Dunes Owners' Association.
- Residential use only: All lots must be used exclusively for single-family residential purposes. No duplexes, apartments, time-shares, or business uses are allowed.
- Architectural review & construction: No building, fence, or other structure may be erected or altered without prior written approval from the Declarant (or its successor). Plans must include exterior colors, finishes, site and landscaping plans, and construction schedule. Approval may be denied for any reason, including aesthetics.
- Minimum house size & built-upon area: Each house must have at least 1,450 square feet of enclosed dwelling area (excluding garages, decks, porches). Each lot has a specific maximum built-upon area (structures and paved surfaces) ranging from 3,000 to 6,795 sq. ft. – see the document for your lot's limit.
- Setbacks & height: Structures may not exceed 2½ stories. The Declarant has absolute control over site location, orientation, and floor elevations. Planting outside the designated building site is limited to grass, flowers, and shrubs under 8 feet tall unless approved.
- Construction timeline & debris: Exterior construction must be completed within 6 months of starting (unless delayed by strikes, fire, natural disaster). Builders must keep the site clean, use a dumpster, and remove all debris.
- Pets: Only dogs, cats, and pet birds may be kept as pets, in reasonable numbers, and not for commercial use.
- Parking & vehicles: No trailers, boats, or habitable motor vehicles may be parked on any part of the property unless under the residence or inside an enclosed garage. This also applies to common easement areas.
- Prohibited items & activities: No exterior radio/TV aerials (except with permission), no clotheslines visible from the street, no discharging firearms, no personal signs on vacant lots (except Declarant's signs), and no individual water supply systems except non-potable lawn irrigation.
