Kure Beach Village, Phase II is a planned unit development (PUD) in Wilmington, NC, governed by a homeowners association (HOA). This document is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) that apply to all lot owners in this single-family residential community. It establishes the HOA, property rights, assessment obligations, and detailed use restrictions for lots.
- What you own & maintain: You own your lot and the home on it. You are responsible for maintaining your lot, including buildings, landscaping, and drainage easements. The HOA owns and maintains the common area (e.g., clubhouse, pool) and carries insurance on it.
- Architectural review: All exterior construction, alterations, fences, and landscaping must be approved in writing by the HOA Board or an architectural review committee. Plans are deemed approved if no decision is made within 30 days of submission.
- Use restrictions: Lots are for single-family residential use only. Minimum home size is 1,350 heated square feet (exclusive of porches, garages, etc.). Exterior materials are limited to conventional frame, wood siding, brick, or stucco. No vinyl, aluminum, or concrete block siding. Homes must be on crawl space or pilings, not on a slab.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed and not allowed to run free. No livestock, pigs, or poultry.
- Parking & vehicles: No boats, campers, trailers, recreational vehicles, or tractor-trailer trucks may remain on any lot without HOA consent. No yard sales or garage sales. Garbage receptacles must be screened from street view except on pickup days.
- Fences & landscaping: Fences must be wood, stained to match the house, no taller than 4 feet, and set back from the front lot line. No chain link or wire fences. Landscaping must be in place within 30 days of certificate of occupancy.
- Assessments & fees: All lot owners pay annual assessments set by the HOA Board, plus special assessments for capital improvements (approved by 2/3 vote) and insurance. Assessments are a lien on the lot. Delinquent assessments accrue 14% annual interest and may be foreclosed.
- Leasing & rentals: The document does not address leasing or rental restrictions. Owners may delegate use of common area to tenants who reside on the property.
