Kure Beach Club is a single-family home subdivision in Wilmington, NC. These covenants, conditions, and restrictions (CC&Rs) run with the land and bind all current and future lot owners. The document establishes rules for residential use, construction, and an owners' association.
- Residential use: All lots must be used for single-family residential purposes only. No house trailers, mobile homes, tents, or temporary structures may be used as a residence. No noxious or offensive activities, yard sales, or garage sales are allowed.
- Construction & minimum size: Any single-family residence must be at least 1,100 square feet (measured by exterior brick work, excluding porches, steps, garages, etc.). No structure may exceed 2½ stories. Accessory buildings must match the main structure's materials and design and cannot be built before the main building.
- Exterior materials: Exteriors must be conventional frame, wood siding, brick, or stucco. Concrete block, concrete brick, asbestos siding, cinder block, aluminum siding, and composition tar paper are prohibited.
- Architectural review: No building, fence, wall, or other structure may be erected or altered until plans, specifications, exterior finishes, and site plan are approved in writing by the developer (or its representative). Approval may be denied for any reason, including aesthetic or environmental considerations.
- Setbacks & site location: No specific setback lines are established; instead, the developer reserves the right to control and approve the site and location of any structure, subject to minimum building code requirements. On corner lots, the side with the least frontage is considered the front lot line.
- Fences & hedges: Fences, walls, or hedges cannot exceed 5 feet in height. No fence may be closer to the front lot line than the rear corner of the dwelling. All fences must be wood, chain-link, or similar; wire fences are prohibited.
- Pets: Only household pets are allowed; no other animals may be kept on the property.
- Signs: No advertising signs or billboards are allowed, except one 'For Sale' sign of no more than 5 square feet for a completed dwelling. No 'For Sale' signs are allowed on vacant property. This does not apply to developer signs.
