Inland Greens is a single-family townhome community in Wilmington, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lot owners in Section 1 and binds owners, tenants, and occupants. The HOA maintains common areas and provides exterior maintenance for each lot.
- What you own & maintain: You own your lot and the townhouse on it. The HOA handles exterior maintenance (roofs, gutters, exterior surfaces, decks, trees, shrubs, walks, glass) unless damage is caused by your negligence, in which case you pay. Party walls between townhouses are shared, with repair costs split proportionally.
- Architectural review: No building, fence, wall, or exterior alteration may be started without written approval from the HOA board or an architectural committee. Plans must be submitted; if no decision within 30 days, approval is deemed given.
- Use restrictions: Lots are for single-family townhouse use only, max three stories. No noxious activities, junk vehicles, temporary structures, or recreational vehicles (boats, campers, trailers) without HOA consent. For-sale signs are prohibited except by the developer. Outside antennas need approval. Window mini-blinds are permanent fixtures; additional treatments must be inside. Exterior lights must be clear or white. Garbage must be stored in garages except on collection days.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be leashed and escorted; absolutely no pets on the golf course.
- Assessments & fees: Annual assessments are levied per lot, initially capped at $1,000/year, with annual increases up to 5% without a vote. Special assessments for capital improvements require a 2/3 vote of each membership class. A working capital assessment equal to two months' estimated assessment is due at title transfer. Unpaid assessments accrue 12% annual interest and become a lien on the property.
- Leasing & rentals: The declaration does not set a minimum lease term or restrict rentals, but owners may use approved rental agents. All rental agreements must comply with the declaration and HOA rules.
- Golf course: The developer owns and operates the adjacent golf course. Each lot owner gets two golf club memberships with discounts on green fees as determined by the developer, which may be changed or withdrawn. The HOA has a right of first refusal to purchase the golf course within 10 years of the declaration.
