Charter Ridge Subdivision is a single-family home HOA in Wilmington, NC. These covenants, conditions, and restrictions (CC&Rs) run with the land and bind all lot owners. The document sets rules for residential use, architectural control, and property maintenance to protect neighborhood values.
- Permitted uses: All lots are for single-family residential use only. No business, trade, or occupation is allowed on any lot, except the developer's sales activities.
- Architectural review: No building, fence, wall, or other structure may be erected or altered without written approval from the Declarant (or later the homeowners association). Plans are deemed approved if not rejected within three weeks of submission. Approval may be based on any ground, including aesthetics, in the Declarant's sole discretion.
- Minimum home size & exterior materials: Each single-family residence must have at least 1,400 square feet of enclosed dwelling area. Exterior materials are limited to conventional frame, brick, clay brick, or stucco; concrete block, concrete brick, asbestos siding, aluminum siding, vinyl siding, cinder block, and tar paper composition are prohibited.
- Fences & setbacks: No fence is allowed closer to the front lot line than the front of the residence. Maximum fence height is 7 feet along side and rear lot lines, and 4 feet on the front. Minimum setbacks are those required by the City of Wilmington Code, but the Declarant may require greater setbacks.
- Vehicles & parking: All driveways and parking areas must be paved. No inoperative junk cars, large trucks, buses, boats, campers, trailers, motor homes, or similar vehicles may be stored on any lot or street without written consent. Recreational vehicles are expressly precluded from parking or storage within the subdivision.
- Pets & animals: Only non-violent domesticated household pets are allowed. No domesticated farm animals or fowls may be kept. All animals must be leashed or otherwise secured when not on the owner's lot.
- Prohibited structures & activities: No house trailers, mobile homes, tents, temporary structures, modular or prefabricated homes, or previously constructed houses are allowed. No yard sales or garage sales are permitted. No outside radio or television antennas (including satellite dishes) may be erected without written approval.
- Signs: Only one 'For Sale' or 'For Rent' sign per lot, maximum 5 square feet, is allowed. No other signs are permitted except those of the developer.
