What Long Leaf Hills's governing documents say
Long Leaf Hills is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1959. These covenants run with the land and apply to all lots in Section 5, primarily regulating residential use, building size and placement, and architectural standards.
- Permitted use & building type: Lots 172–201 are for residential use only, with one detached single-family dwelling (max 2.5 stories) plus a one- or two-car garage. Tract 'B' is reserved for commercial businesses.
- Setbacks & lot subdivision: No building may be erected within 60 feet of the front street line or within 10 feet of an adjacent property line. Lots may not be resubdivided unless the split creates whole lots.
- Minimum dwelling size & materials: Each dwelling must have at least 1,100 square feet of interior area (with possible exceptions for porches/garages under the main roof). Exterior materials must be wood, stone, brick, brick veneer, tile, stucco, concrete, or asphalt shingles; garages must match the dwelling's materials.
- Architectural review: Building designs must be approved by the developer or a committee. The reviewer has 10 days to act; if no response, approval is not required as long as the design harmonizes with existing structures.
- Prohibited structures: No trailer, basement, tent, shack, garage, barn, or other out-building may be used as a residence.
- Sewerage & drainage: Until municipal sewer is available, septic tanks must meet state health board approval. Each owner must install and maintain a driveway culvert or drainage pipe at least 12 inches in diameter to avoid blocking natural drainage.
- Enforcement & duration: Any property owner in the development may sue to enforce these covenants. The restrictions run until May 1, 1984, after which they may be waived (except for pre-existing restrictions from the chain of title).
